Terms of Service

1.Acceptance of terms

These Terms of Service govern your access to and use of the TracGlobal platform, hardware and related services, operated by TracGlobal, a subsidiary of Anitrack Group of Companies (“TracGlobal”, “we”, “us”). By creating an account, installing a device or using the service, you agree to these terms.

2.The service

TracGlobal provides GPS-based vehicle and asset tracking, including live location, trip history, geofencing, reporting and alerts. Features may change as we improve the platform. The service depends on third-party networks (GPS and mobile coverage) and may be affected by factors outside our control.

3.Accounts

You are responsible for keeping your login credentials confidential and for all activity under your account. You must provide accurate information and notify us promptly of any unauthorised use. You must be authorised to track any vehicle or asset you add to the platform.

4.Hardware and installation

Tracking devices may be sold, leased or installed by TracGlobal or its partners. You are responsible for ensuring devices remain powered and unobstructed. Tampering with, removing or relocating a device may affect tracking accuracy and the warranty.

5.Promotional first year free

Every new installation includes one (1) year of platform access with no subscription fees, starting from activation. The promotional year covers standard tracking features; hardware, installation, SMS credits and any third-party charges are not included unless stated in writing.

After the free year, continued access is subject to our then-current subscription fees, which we will communicate before any charge applies. The offer is non-transferable and may not be combined with other offers unless we agree otherwise.

6.Acceptable use

You agree not to:

• Use the service unlawfully or to track a person or asset without authority.
• Interfere with, disrupt or attempt to gain unauthorised access to the platform.
• Resell or provide the service to third parties without our written consent.
• Reverse engineer or misuse any part of the platform or hardware.

7.Fees and payment

Fees for hardware, installation and post-promotional subscriptions are as quoted to you. Unless stated otherwise, fees are exclusive of applicable taxes and are payable in advance. Late or non-payment may result in suspension of the service.

8.Intellectual property

The TracGlobal platform, software, branding and content are owned by TracGlobal and its licensors. We grant you a limited, non-exclusive, non-transferable right to use the service for your own tracking purposes during your subscription.

9.Disclaimers and liability

The service is provided “as is”. We do not warrant uninterrupted or error-free operation, and tracking data may be delayed or inaccurate due to network or device conditions. To the maximum extent permitted by law, TracGlobal is not liable for indirect or consequential losses, and our total liability is limited to the fees you paid for the service in the prior twelve months.

10.Termination

You may stop using the service at any time. We may suspend or terminate access for breach of these terms, non-payment or unlawful use. On termination, your right to use the platform ends; we will handle your data in line with our Privacy Policy.

11.Governing law

These terms are governed by the laws of the Republic of Ghana, and any disputes are subject to the exclusive jurisdiction of the courts of Ghana.
